The system has become more centralized, with state legislators and federal judges given increasing power. The liberal Warren Supreme Court’s emphasis on procedures, not equity, joined hands with conservative insistence on severe punishment to create a system that is both harsh and ineffective.

What would get us out of this Kafkaesque world? More trials with local juries; laws that accurately define what prosecutors seek to punish; and an equal protection guarantee like the one that died in the 1870s, to make prosecution and punishment less discriminatory. Above all, Stuntz eloquently argues, Americans need to remember again that criminal punishment is a necessary but terrible tool, to use effectively, and sparingly.

5Spectacular, paradigm-changing bookOct 13, 2011

The legal academy lost a giant earlier this year when William Stuntz passed away from an aggressive cancer. Stuntz was an amazing scholar who had the gift of explaining how legal doctrine in the area of criminal procedure frequently failed to measure up to the real world. "The Collapse of American Criminal Justice" is his defining masterpiece that marshals statistics, history, and logic to argue that our current criminal justice system is badly broken. He points to the facts that (1) we incarcerate more people per capita by far than our peer nations (550+ per 100,000, versus the 50-150 range), and in fact, we eclipse even Russia; (2) we incarcerate so many African-American men that in some cities, 1/3 or more of young African-American men are in prison, probation, or supervised release; (3) most criminal defendants plead guilty.

The reasons for this breakdown are complicated, but Stuntz attributes it to a number of key factors. First, he points to the increasing centralization of criminal justice. It used to be that the judges, prosecutors, and juries in criminal cases came directly from the neighborhood that the criminal defendant did. This meant that there were local pressures to temper justice with mercy, since the defendant being sent away for incarceration was part of the community too. With the growth in suburban population, however, coupled with having larger districts -- meaning that the jury pool came from a wider swath of the population -- this local control was lost. Worse yet, the voting strength of the suburbs meant that the increasing bulk of voters were voting to reduce crime, even though they (suburbanites) were hardly the target of crime. The inner cities were.

Second, Stuntz faults the Supreme Court during the reign of Chief Justice Earl Warren for its reliance on procedural protections that simply raised the cost of trials, without making them more accurate. Prosecutors have been able to evade these protections by inducing defendants to plead guilty, such inducements made more enticing because the substantive criminal law -- the part of the law governing what is a crime -- was left alone by the Court, and roamed free and wild. With broader laws available, prosecutors are able to ensnare more and more people, and pleading guilty becomes preferable to risking a long and protracted trial.

Stuntz's solution is to return to local juries, local judges, local prosecutors, and to allow juries to play a more important role in the criminal justice system. (Right now, they are only responsible for finding the facts.) He is of course cognizant of the sordid past of the Jim Crow era in the South, when all-white juries frequently engaged in jury nullification in favor of white defendants accused of killing African-Americans. This, he contends, is less of a problem today than the problem of discriminatory charging. Thus, Stuntz suggests that prosecutors be required to demonstrate that they are prosecuting people of different races for the same kinds of crimes, a proposal that would prevent prosecutors from harassing disfavored minorities.

This is a spectacular, paradigm-shifting book. The arguments that he makes are daunting, and the solutions would be challenging to implement. He might not fully persuade as to his diagnosis or his prescription, but this book is guaranteed to make you think about the criminal justice system in a new way.

We have a book outlining William J. Stuntz's contribution to our understanding of criminal law. He is no longer with us, but we have the book to memorialize his life's work.

Stuntz tells us quite clearly how our criminal justice system works today. Crimes are numerous, narrowly defined and almost self proving. Three factors (ease of proof by the prosecution, multiple offenses chargeable for the same events, and the high cost of trials) mean that 90 to 95 percent of defendants perceive that they do not have a chance to defeat the prosecution and enter into "plea bargains." Stuntz shows accurately that these are not "bargains" in the traditional sense of the word (negotiated agreements in which both sides reach an improved position) but rather Hobson's choices in which one can elect between the devil and the deep blue sea. Consequently, both state and federal prisons are always full, and only the limited supply of beds prevents more convictions. Stuntz is very correct to tell us that this is not the criminal justice system taught in civics classes. It flunks Stuntz's personal standard of justice and most people's common sense notion of justice. Persons accused of crimes are not imprisoned based on fair proceedings conducted by unbiased judges and based on facts decided by juries of their peers. Persons accused of crimes in most cases go to prison because acts they have committed (or are thought to have committed) are judged to be threats to the community by police and prosecutors with limited supervision by overworked judges and the rare jury trial. Jury nullification is limited by the narrow definitions of crimes, so that even in the rare jury trial a jury cannot often interpose its values about who should or should not be punished for particular actions.

Stuntz tells us that this system flows from two sources: 1. Supreme Court jurisprudence on criminal procedure which vastly increases the cost of jury trials, and 2. reactive legislation on the definition and multiplication of crimes as well as sentencing guidelines which allow police and prosecutors to obtain convictions and long sentences without incurring the high cost of jury trials. The first may well be an unintended consequence, the second is undoubtedly an intended response. In short, we have the criminal justice system that federal and state legislatures have decided we should have. Criminal justice today is dominated by legislatures, not judges, lawyers or even the Supreme Court.

Anyone who wants to know the history of our criminal law, giving an account of how we reached this point, should read this book.

There is much to criticize in this book, and much to disagree with. However, dead men cannot rebut their critic's arguments. In fairness then, rather than point out my areas of strong disagreement with Stuntz, I prefer to encourage all who are concerned with the rule of law to read the book and note their own personal areas of disagreement.

5A surprising and fascinating accountNov 26, 2011

An excellent book, and not just for those interested in law. In many ways this is a study in unintended consequences. Stuntz explains how the decisions of the Warren Court (Mapp, Miranda, etc.) ended up actually widening the gap between rich and poor, by making jury trials difficult and expensive and acquittals rare, putting judicial power into the hands of prosecutors rather than judges and juries. And even more fascinating is how the "war on drugs" actually has a benefit: since intimidation of witnesses ("Don't snitch") has made it almost impossible to convict gang members of actual crimes like murder and robbery, drug crimes are used as substitute prosecutions, since they don't require witness testimony. These are just two examples of the many perceptive analyses in the book. The title is just a bit hyperbolic, ("flaws" rather than "collapse" might be more accurate), but this is highly recommended for anyone with an interest in what's going on in American society today.

Stuntz provides the intellectual and moral compass of the reality which we now face regarding a legal-world red shift: an expanding universe of crime definition, excessive charges with cumulative punishment brought by prosecutors to obtain plea bargains in lieu of trials, algorithmic sentencing by judges, all of which leads to a rate of incarceration in the United States which is five times the rate in the other western democracies and equal only to that in Russia. How this could happen in a country which is supposed to be the poster child for democracy is still a mystery. The data is out there, much of it on the Web. Stuntz is our Virgil. My only criticism is that the author should have made greater use of graphical rather than tabular presentation of his results. The narrative is gripping nevertheless. His description of the pendulum swing of severity versus leniency in criminal justice reminded me of one of the routes to chaos in mathematics or of the marvelous scene in Kafka's "Der Process" in which a prosecutor,
while rummaging through papers on his desk, finds an indictment which is still alive and has the defendant re-arrested and so on in a concatenation of arrests and rearrests which possibly could meet one of the mathematical criteria for chaos.

5Hobson's Choice - The Price of Cheap JusticeApr 23, 2012

This scholarly work by William J. Stuntz is truly an inflammatory condemnation of the existing criminal justice system in America. If only the public policy makers would absorb the facts that he presents and take action to replace cheap justice with true justice. As the book highlights, and recent U.S. Supreme Court cases have acknowledged, the system is now dominated by plea bargains that serve as the vehicle to dispose of 96 percent of criminal cases. The time honored role of a jury of one's peers is for all practical purposes defunct. The prosecutor now dominates the entire process from the outset. The arraignment involves multiple and overlapping charges in order to create escalated penalties affording the prosecutor maximum leverage for the ultimate disposition of the case by means of a plea bargain. Any question regarding guilt or innocence and appropriate penalties is decided by a Hobson's Choice awaiting the defendant in a plea bargain offer fashioned by the prosecutor. Juries have been removed from their time honored role as finders of fact, guilt, and a just penalty based on the unique circumstances of the case and charges. "The Collapse of American Criminal Justice" describes the injustice of the current process and the unequivocal need for reform. It also describes the social, political, economic, and structural barriers that impede any true prospect of meaningful change. The U.S. Supreme Court has recently recognized the implications of the plea bargain system and the inordinate powers of prosecutors in two recent cases. In Missouri v Frye and Lafler v Cooper the Court has started to address the need for defendants to have competent counsel when confronting the Hobson's Choice of plea bargains. Unfortunately, as Professor Stuntz's book illustrates, the competence of the defendant's counsel is a poor substitute for a jury. The overwhelming power and discretion of prosecutors and the emasculation of judges and juries in the pursuit of cheap justice will demand much more from the Justices. One can only hope that they will read this book. The untimely death of Professor Stuntz is tragic in many ways including the loss of his brilliant mind to champion essential reforms. His book is a legacy that lawmakers should read and then honor with their deliberation and action.
