This is a panorama of Health Insurance Portability and Accountability Act (HIPAA) of 1966. It was published in 2007. So it is fairly recent. This book is a self-contained introduction, while in certain Code of Federal Regulations (CFRs) like 45 CFR 164.308 and others; it is complete enough that it can be used as reference.
Published by ABA Section of Science & Technology Law, it does cover the legal aspects of patient information as it is in electronic Protected Health Information (ePHI) area. This book provides technology oriented useful and practical information.
Chapter 1 is a good high level introduction. Chapter 2 provides a concise background and history of HIPAA. Starting with Chapter 3, it gets to the jest of HIPAA Privacy and Security. It goes into Privacy and Security Rules and HIPAA Statutory Requirements. Chapter 4 is more robust in discussing Scope and Applicability of the Security Rule. This chapter has a good discussion of scope and entities regulated by the Security Rule. This includes business associates, health plan sponsors, and health care components. Chapter 5 is a complete discussion of the Security Rule and a lot of information about Section 164.308 details. It describes access management, authorization, protection against malicious software, password protections, physical protection, transmission security, etc. Chapter 6 is about implementation. It has useful information regarding "State of Compliance" as it applies to Regulatory Regulations. Chapter 7 is focused on enforcement. It talks about civil, criminal, and monetary penalties. This is informative, brief, and to the point information. Chapter 8 is about Litigation and Liability. However, as an icing on the cake, there is a one-and-a-quarter-page brief, too brief I might say, conclusion.
The book provides Appendices 1, 2, and 3 of some 174 pages. I was most impressed by this helpful and complete collection of what I needed to know as a Senior Management and Technology consultant that had to work with HIPAA Security at a major Health Care Provider.
This is a good and informative book.
